Possession, Trafficking and Other Drug Charges

Drug charges can involve any number of legal and illegal drugs, including marijuana, methamphetamines, ecstasy, cocaine, crack, speed, heroin, opiates and prescription drugs. At the law office of Edward Chu, we have experience with a wide variety of drug charges, but most often see clients charged with marijuana (cannabis) or cocaine-related offences.

The governing statutes are the criminal code of the Controlled Drugs and Substances Act. A drug charge of any kind can be very serious, and can involve consequences you might not expect. This is especially so with the mandatory minimum sentencing regime passed by the government. Even if you are not sentenced to any prison time, you could end up with a criminal record, which may block you from certain jobs or career paths. Your ability to travel internationally — such as the United States — may be affected, possibly for a long time.

As mentioned above, many drug offences include mandatory minimums. These are set out in the Controlled Drugs and Substances Act (CDSA). If you are found guilty, the judge will have no choice (no discretion) but to send you to prison for a set amount of time mandated by law.

You may also face the loss of your property, including your house, money or car, particularly if it was involved in trafficking or production.

Defending Drug Offences

Our lawyer can help you with a number of charges, including:

  • Possession (simple possession)
  • Possession for the purpose of trafficking
  • Production and cultivation (e.g., marijuana or methamphetamines)
  • Theft of hydro (grow operations)
  • Conspiracy to traffic

One of our primary methods of defence involves thoroughly examining all of the evidence the Crown has against you — including physical evidence, exhibits, police officers' notes, witness statements and even confessions — to see if there are any defects or problems — while being alert to possible Charter rights violations with search and seizure.
